This User Agreement explains the terms for creating an account and using NorthDuty to monitor websites, pages, visual changes, and user journeys.

Agreement and account eligibility
NorthDuty is a website monitoring service operated by LUMENSOFT S.R.L. ("NorthDuty", "we"), a company registered in the Republic of Moldova. By creating an account, accepting an invitation, accessing NorthDuty, or using the service, you agree to this User Agreement on behalf of yourself or the organization you represent. NorthDuty may be used by individuals and businesses. If you use NorthDuty for an organization, you represent that you have authority to accept this agreement for that organization.
You must provide accurate account information, keep credentials secure, and promptly update account, workspace, billing, and notification information when it changes. You are responsible for activity under your account and for users invited to your workspace.
NorthDuty service
NorthDuty provides website monitoring software that may include health checks, uptime and reachability checks, SSL and DNS checks, performance and stability signals, JavaScript error and failed-resource detection, screenshot capture, visual diff comparison, AI-suggested user journeys, user journey runs, reports, alerts, and related workflow features.
NorthDuty may change, improve, suspend, remove, or limit features from time to time. Some features may depend on third-party services, infrastructure availability, browser automation, network conditions, customer configuration, usage limits, or plan availability.
NorthDuty is a monitoring and evidence tool. It does not guarantee that every outage, defect, security issue, legal issue, content change, accessibility issue, SEO issue, broken flow, or business loss will be detected or prevented.
Authorized monitoring
You may use NorthDuty only to monitor websites, URLs, pages, flows, accounts, and services that you own, operate, administer, or are otherwise authorized to test. You are responsible for making sure your monitoring configuration complies with applicable laws, contracts, policies, and third-party terms.
You must not use NorthDuty to scan, stress, disrupt, overload, scrape, attack, bypass controls, access restricted systems, collect data unlawfully, or monitor third-party services without permission. NorthDuty may suspend or limit checks that appear abusive, risky, unlawful, or harmful.
Customer content and monitoring data
You retain ownership of the URLs, configurations, project names, journey steps, screenshots, visual diffs, reports, alert destinations, and other content you submit to or generate through NorthDuty. You grant NorthDuty the rights needed to host, process, transmit, display, reproduce, analyze, and store that content to provide, secure, support, and improve the service.
You are responsible for the content and data you configure NorthDuty to access, capture, store, or send. Avoid entering unnecessary secrets, payment data, protected health information, highly sensitive personal data, or confidential material into monitored URLs, journey steps, project names, reports, alerts, or other fields unless you have determined that doing so is appropriate for your own requirements.
Acceptable use
You may not use NorthDuty in a way that violates law, infringes rights, harms others, interferes with service operation, attempts unauthorized access, reverse engineers the service, circumvents limits, abuses trials or promotions, sends unlawful notifications, or introduces malware, harmful code, or deceptive content.
You may not resell, sublicense, or provide NorthDuty as a managed service to third parties unless NorthDuty has agreed in writing. Agencies and consultants may use NorthDuty to monitor client websites when they have authorization from those clients and remain responsible for workspace access and configuration.
Plans, billing, and cancellation
NorthDuty offers a free plan that does not require payment. To expand limits and features beyond the free plan, a user must explicitly select a paid plan.
NorthDuty will never charge you before you have explicitly selected a paid plan and completed checkout. Once you subscribe to a paid plan, the subscription renews automatically at the end of each billing period and the payment method on file is charged at each renewal until you cancel. You can cancel at any time from the app or by emailing support@northduty.com, and cancellation takes effect at the end of the current billing period.
Paid plans, limits, prices, billing intervals, included projects, included checks, and feature availability may be shown on NorthDuty pricing pages, in the app, or in an order process. Fees are due according to the selected plan or agreed order terms. Payments for paid plans are processed by Paddle.com Market Ltd ("Paddle"), acting as merchant of record, and your order is also subject to Paddle's checkout terms. Applicable taxes are calculated and collected at checkout.
Refunds are handled according to the NorthDuty Refund Policy, which includes a 30-day money-back guarantee on paid subscriptions. You are responsible for payment method accuracy and billing information. NorthDuty may suspend or downgrade service for unpaid, disputed, failed, or overdue payments.
You may cancel or stop using NorthDuty at any time, but cancellation does not remove responsibility for fees already incurred. Some data may be retained for backups, legal, billing, fraud prevention, security, or operational records.
Alerts, reports, and service reliability
NorthDuty alerts and reports depend on customer configuration, third-party providers, network conditions, queues, browsers, email delivery, notification destinations, and monitored website behavior. You are responsible for reviewing alert rules, destinations, schedules, and results.
NorthDuty should not be your only operational control for emergency, safety-critical, life-critical, financial-critical, or legally required monitoring. Maintain your own incident response, backup, security, and business continuity processes.
Intellectual property
NorthDuty and its software, designs, branding, workflows, generated product interfaces, documentation, and related materials are owned by NorthDuty or its licensors. This agreement gives you a limited, revocable, non-exclusive, non-transferable right to use NorthDuty according to your plan and this agreement.
Feedback, suggestions, and ideas you provide may be used by NorthDuty without restriction or compensation, provided NorthDuty does not identify you as the source without permission.
Suspension and termination
NorthDuty may suspend, limit, or terminate access if NorthDuty believes there is a violation of this agreement, security risk, abusive activity, unlawful use, unpaid fees, excessive load, third-party complaint, or risk to NorthDuty, customers, users, or monitored systems.
After termination, your right to use NorthDuty ends. NorthDuty may delete or retain account and monitoring data according to the Privacy Policy, operational needs, legal requirements, billing records, backups, and security obligations.
Disclaimers and liability
NorthDuty is provided on an as-is and as-available basis to the fullest extent permitted by law. NorthDuty disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free operation, and guaranteed monitoring results.
To the fullest extent permitted by law, NorthDuty will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, business interruption, or failure to detect a website issue. NorthDuty's aggregate liability for claims related to the service will not exceed the amounts paid to NorthDuty for the service during the three months before the event giving rise to the claim, or one hundred U.S. dollars if no fees were paid.
Changes and contact
NorthDuty may update this User Agreement from time to time. When changes are material, NorthDuty may provide notice through the website, the app, email, or another reasonable channel. Continued use of NorthDuty after changes become effective means you accept the updated agreement.
